Guarantees

The guarantee of the products offered by Basketball Emotion through its website https://www.basketballemotion.com and all its physical points of sale implies that:

a) The Product will be delivered in perfect condition and in the quantity requested.

b) The Product will conform to the characteristics most recently indicated by the manufacturer, as established on the website or in the description of the Product's materials at the time of placing the order.

Sports Emotion Hub S, L. makes every effort to deliver the Products in optimum condition. However, in the event that you receive a Product that you consider to be defective, you must keep it in its current state so that we (or our agent) can check it within a reasonable period of time. In the event of a defective product, the seller must proceed, as appropriate, to repair, replace, reduce the price or terminate the contract, which will be free of charge for the consumer and user. The seller is liable for any lack of conformity that becomes apparent within three years of delivery. The consumer and user must inform the seller of the lack of conformity within two months of becoming aware of it. This clause shall be applied taking into account the nature of the goods marketed. 

To activate the guarantee it is necessary to present: 
Invoice of purchase from Sports Emotion Hub S, L.
 In any case, the serial number of the product to be repaired must correspond with the files owned by Sports Emotion Hub S, L. 
 The guarantee will start on the same day of delivery and/or acceptance of the order.

If, in accordance with the terms of the Contract, you wish us to repair or replace the Product or refund the amount paid, you must ensure that the Product: 

(a) has not been misused or neglected, has not been mishandled or mishandled in an improper or reckless manner and has not been subjected to abnormal or harmful conditions. In this respect, manufacturing defects shall not be deemed to be manufacturing defects but misuse and/or wear and tear caused by normal use:

A.1 ) Any custom product washed with corrosive chemicals.

A.2) Any custom product washed without following the manufacturer's instructions. Example: Washing at more than 30ºC. 

A.3) Any product that has not been properly maintained. More information in our material guide section. 

A.4) Any damage caused as a result of a wrong choice of size. Example: goalkeeper glove with untight seams or boots with open toecaps. More information in our equipment guide section.

(b) has not been involved in any accident or been damaged in any attempt to repair or modify it. In this respect, manufacturing defects shall not be considered to be manufacturing defects but misuse and/or wear and tear caused by normal use: 

B.1 ) Any damage occurring as an incidental consequence of the game. Example: erosion of the boot shell due to abrasion on the pitch, damage to the shell caused by a foot strike or erosion of the latex due to abrasion on the pitch. 

c) It has not been used in a manner contrary to the manufacturer's instructions for the Product. In this respect, manufacturing defects shall not be considered to be manufacturing defects but misuse and/or wear and tear caused by normal use: 

C.1) Any damage to FG studded football boots (recommended for use on dry natural grass pitches) used on synthetic turf, regardless of the number of uses. More information can be found in our equipment guide section. 

d) Has not deteriorated due to natural wear and tear after receipt. More information in our material guide section.

(e) In the case of goalkeeper gloves, it should be noted that the palm of such gloves is made of natural latex. The extreme softness of this material influences its durability to such an extent that dragging the palm on the ground, even during the first use, can lead to erosion of the latex. Goalkeeper gloves maintain their grip and cushioning properties until palm erosion is approximately 75%. More information can be found in our material guide section. 

f) It has a defect that affects the safety normally offered by other gloves of the same series. In this respect, aesthetic defects shall not be considered manufacturing defects and, if applicable, the right of withdrawal shall be invoked.

g) It has a defect which affects the safety normally offered by the other items of the same series. In this respect, neither aesthetic damage nor the fact that a product produces scratches shall be considered as manufacturing defects and recourse shall be had, if applicable, to the right of withdrawal.

h) The product has not been altered or attempted to be repaired in person or in a shop prior to the claim of the defect.

f) It presents a defect that affects the safety normally offered by the other copies of the same series. In this respect, aesthetic defects shall not be considered manufacturing defects and, if applicable, the right of withdrawal shall be invoked.

g) It has a defect which affects the safety normally offered by the other items in the same series. In this respect, neither aesthetic damage nor the fact that a product produces scratches shall be considered as manufacturing defects and recourse shall be had, if applicable, to the right of withdrawal.

h) The Product has not been altered or attempted to be repaired in person or in a shop prior to the claim of defect.

In the event that the Product does not meet any of the above requirements, we may decide, at our discretion, not to repair or replace the Product or to refund the amount paid and/or we may ask you to reimburse the full costs of transport and servicing incurred at the current standard rates. In order to make such reimbursement, we may charge the above costs to your credit or debit card account or use the payment details provided when placing the Order. To the extent permitted by law, we are not responsible for any losses, liabilities, costs, damages or expenses that may result from the process.
